1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Manea Events ("Company," "we," "us," or "our"), governing your access to and use of the website located at https://maneaevents.com (the "Site") and any services offered through it. By accessing the Site or submitting a booking inquiry, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to comply with these Terms. If you do not agree, please discontinue use of the Site immediately.

2. Services Description

Manea Events provides Polynesian entertainment, Hawaiian catering, and related event services including but not limited to luau shows, fire-knife performances, hula entertainment, catering packages, and event production. All services are subject to availability and a separate written service agreement or signed contract between the parties.

Information on the Site regarding pricing, packages, and availability is provided for general informational purposes only and does not constitute a binding offer. Final pricing and terms are confirmed in a written proposal or contract.

3. Booking, Deposits & Payment

• Reservation: A booking is not confirmed until a signed contract and required deposit have been received by Manea Events.
• Deposit: A non-refundable deposit (typically 50% of the total contract value, unless otherwise stated in writing) is required to secure your event date. The deposit amount will be specified in your proposal.
• Balance: The remaining balance is due no later than the date specified in your contract, which is typically 7–14 days prior to the event date.
• Late Payment: Failure to remit the balance by the due date may result in cancellation of services at the Company's discretion, with the deposit forfeited.
• Accepted Payment Methods: Accepted forms of payment are specified in your contract and may include credit/debit card, ACH transfer, check, or cash.

4. Cancellation & Rescheduling Policy

• Client Cancellation: All deposits are non-refundable. If you cancel within 30 days of the event date, the full contract balance may be owed depending on costs already incurred. Specific cancellation terms are outlined in your signed contract.
• Rescheduling: Rescheduling requests are subject to availability and must be made in writing at least 14 days prior to the original event date. One complimentary reschedule may be offered at the Company's discretion.
• Company Cancellation: In the unlikely event that Manea Events must cancel due to circumstances within our control, we will provide a full refund of all amounts paid or make reasonable efforts to arrange a comparable replacement.
• Force Majeure: Neither party shall be liable for cancellation or delay caused by circumstances beyond reasonable control, including but not limited to natural disasters, government orders, public health emergencies, or acts of God. Deposits remain non-refundable in force majeure situations unless otherwise agreed in writing.

5. Client Responsibilities

To ensure a successful event, the client agrees to:

• Provide accurate event details including date, time, venue address, guest count, and any special requirements at the time of booking.
• Ensure the venue is accessible, safe, and suitable for the agreed-upon services, including adequate space, power access (if required), and compliance with local fire and safety codes for fire performances.
• Obtain any required permits, venue approvals, or HOA permissions for the event and services.
• Notify Manea Events of any changes to event details at least 14 days in advance.
• Ensure guests and venue staff treat our performers and staff with respect. Manea Events reserves the right to cease services without refund if our team is subjected to harassment, unsafe conditions, or hostile behavior.

6. Intellectual Property

All content on the Site — including text, photographs, videos, graphics, logos, and choreography concepts — is the property of Manea Events or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on this Site without prior written permission from Manea Events. Limited personal, non-commercial use is permitted provided you do not remove any copyright or proprietary notices.

7. Photography & Media Release

Manea Events may photograph or video record performances and events for marketing, promotional, and portfolio purposes. By booking our services, you grant Manea Events a non-exclusive, royalty-free license to use event photos and footage featuring our performers and services on our website, social media, and marketing materials.

If you do not wish to be photographed or filmed, please notify us in writing prior to the event. We will make reasonable efforts to accommodate your request, though we cannot guarantee exclusion from all incidental footage.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Manea Events shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services, including but not limited to loss of revenue, loss of profits, loss of data, or personal injury.

Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the total amount paid by you to Manea Events for the specific event giving rise to the claim.

9. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Manea Events does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Indemnification

You agree to indemnify, defend, and hold harmless Manea Events and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your breach of any representations made herein.

11. Third-Party Links

The Site may contain links to third-party websites for your convenience. These links do not constitute an endorsement by Manea Events of those sites or their content. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation.

If negotiation fails, disputes shall be resolved by binding arbitration in Clark County, Nevada, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

13. Changes to These Terms

Manea Events reserves the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Site. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.
